Terms of Service
The terms on which the games are offered and played.

Who we are and what these terms cover
Last Call Games is operated by Mocoding LLC, Miami, USA ("we", "us", "our"). These terms govern your use of lastcallgames.com and of the games played through it (together, the "Service"). By visiting the Service, joining a game or hosting one, you agree to these terms. If you do not agree to them, do not use the Service. You can reach us at contact@lastcallgames.com.
Hosting and playing
Hosting a game requires an account. You are responsible for keeping your account secure and for everything done through it. A host is responsible for the games they host and for whom they share a game's code with: the code is the key to that game, and anyone who has it can join the game and read its record. Players need no account; they join with the code and a name of their choosing. The name must not be offensive, misleading or another person's.
The cases involve a death, told without gore, and the attitudes of their period; we suggest them for players aged 12 and over. You may host a game only if you are at least 13 years old and old enough to enter into these terms where you live. A host who lets younger players join a game is responsible for the suitability of the case for them.
The suspects and the stories
The suspects are played by artificial intelligence. Their answers are generated in response to the questions asked and are not reviewed by us before they are shown; they may be inaccurate, inconsistent, incomplete or unexpected, and they may differ from one game to the next. Every case is fiction: its places and the people in it are invented, and any resemblance to real persons, living or dead, is coincidental. Nothing a suspect, a narrator or the Service says is advice of any kind — legal, medical, financial or otherwise — and you should not rely on it as such.
Fair use
You may use the Service only as these terms allow and only in compliance with the law. You must not use the Service to harass, threaten or defame anyone, to put another person's private information into a question or a name, or to attempt to make a suspect produce content that is unlawful, harmful or abusive. You must not interfere with the Service or its security, overload it, gain or try to gain access to a part of it or an account that is not yours, circumvent a limit it imposes, or copy, scrape, decompile or otherwise reverse engineer any part of it, except where the law gives you a right we cannot exclude.
What you put in
You keep whatever rights you have in the names and questions you put into a game. By putting them in, you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, transmit, display and process them as needed to run the game, to show them to the game's players and host, and to operate, secure and improve the Service. You are responsible for what you put in, and you confirm that you have the right to put it in and that it does not infringe another person's rights. A game's record, including the names and questions in it, is kept as the privacy statement describes; the privacy statement also explains how personal information is handled and the choices you have.
What is ours
The Service and everything in it other than what users put in — the cases, their characters, art, text, audio and design, the software and the Last Call Games name and marks — belong to Mocoding LLC or its licensors and are protected by copyright, trade mark and other laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service to play and host games as these terms allow, including showing a game to the people at your table and to an audience you share your screen with. You may not otherwise copy, sell, distribute, republish or create derivative works from any part of the Service.
Suspension and termination
We may suspend or end a game, suspend or close an account, or restrict or withdraw your access to the Service, with or without notice, where we reasonably believe you have breached these terms, where the law requires it, or where it is necessary to protect the Service or its users. You may stop using the Service at any time. The sections of these terms that by their nature should survive — what you put in, what is ours, the disclaimer, the limitation of liability and the general terms — survive the end of your use of the Service.
As is
The Service is provided "as is" and "as available". It may change, pause or end at any time without notice. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy or freedom from error, and any warranty as to the content the suspects generate. Nothing in these terms excludes a right the law gives you that cannot be excluded by agreement.
Limitation of liability
To the fullest extent permitted by law, we and our officers, members, employees, contractors and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or in connection with the Service or these terms, however caused and under any theory of liability, even if we have been advised of the possibility of such loss. To the same extent, our total liability for all claims arising out of or in connection with the Service or these terms is limited to the greater of the amount you have paid us for the Service in the twelve months before the claim arose and one hundred US dollars. Nothing in these terms limits a liability that the law does not allow to be limited.
Governing law and disputes
These terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws that apply to Mocoding LLC at its place of business, without regard to conflict-of-law rules, and are subject to the courts that have jurisdiction there. Where the law of the country or state in which you live gives you the benefit of its own law or of its own courts and does not allow that benefit to be waived, nothing in this section takes it away. Before bringing a claim, write to us at contact@lastcallgames.com; most disagreements can be settled that way.
General
These terms, together with the privacy statement, are the entire agreement between you and us about the Service and replace any earlier understanding. If a court finds any part of these terms unenforceable, that part is enforced to the extent the law allows and the rest stays in force. Our not enforcing a term is not a waiver of it. You may not assign your rights under these terms; we may assign ours to a successor of the Service.
Changes to these terms
We may update these terms from time to time. When we do, the date at the top changes with them, and the current version is published at this address. Where a change is material, we will take reasonable steps to bring it to your attention. Using the Service after a change takes effect means you accept the terms as changed.
